thank you for joining us i'm eric thomas. and i'm kristen sze. major step today by bay area transit system toward keeping trains and passengers on time. katie marzullo has details. >> reporter: right now, commuters would see a message board like this. it doesn't say much just the date and time, when you depend on public transportation there is no greater gift than accurate information. so, as of this morning, caltrain is going to be testing a new system. it will tell new real-time, if

your train is on time or late, arriving and departing. it is going to be based on gps, which is already on the trains. both electronic messages will tell you whether your train is on time or late. also, a public announcement. right now some stations only have the public announcement. other stations have nothing. we talked with some of the commuters this morning. they say it sounds promising. >> connections, from the train is an issue. i'm like 5 or 10 minutes late for that connection which makes me late for work. having the gps and that time ahead of time would be wonderful. >> message board is a general announcement, not time-based. except sometimes they show the time. it would be nice to have updates on the message board. >> reporter: the testing is all this week on the new system today through friday. it begins at 10 a.m. and runs

until 3:00 in the afternoon. the announcements on the message board and audio will begin with this, "this is a test." the real-time information will be available on caltrain's website. you can get texan e-mail alerts. -- you can get text and e-mail alerts. you will know where your train is whether it is on time or late. the system is expected to be up and running by the end of the year. katie marzullo, abc7 news. developing news out of oakland. right now police are looking for a gunman who shot and wounded five people last night while they waited outside a theater. police were called to the regal theaters on second and washington shortly after 9:30 last night. witness says the victims were waiting outside the theater when a car pulled up and someone opened fire. three were able to get to a hospital. two others had to be taken by ambulance.

the victims were all expected to survive. amy hollyfield will have a live report coming up. this morning a judge will hand down a ruling that could impact governor brown's tax plan. at issue, where on the ballot the proposition will land? he signed legislation the end of june that will put his initiative at the top of the ballot. a los angeles attorney has filed suit to block the legislation and put her own initiative at the top. the decision will place the proposition either first or eighth on the ballot. internet service providers expect few customers to be affected by a malware threat. in 2007 cyber criminals designed software -- malware infected millions of computers. the fbi shut 'em down last year. authorities have been warning users the system they put in place to counteract the malware would end this weekend. between 46 and 64,000 computers in the u.s. are

still infected. >> if you were infected you had to go through them to get on the internet many once they went down you couldn't get online. the fbi replaced their server with its own clean servers. out in fbi is taking those servers down which means if you are infected, you are out of luck. >> experts say the problem can be fixed easily by calling yourselves provider or find instructions through a link on abc7news.com, look see it on tv. environmentalists expected to turn in enough signatures in san francisco today to qualify a november ballot measure that would require a plan to drain a reservoir. the group says voters have a chance to bring the valley back on par with the pristine beauty of the yosemite valley. it was spectacular. opponents say it would be

impractical and a big waste of millions. the developers of san francisco's 60 story condo tower land begin building the second tower this week. the development company plans to break ground this week on a 50 story tower built next to the first tower finished in 2008 as the real estate market went into a tailspin. in marin garbage rates heading up in areas near mill valley and tiburon. supervisors are expected to review a plan tomorrow that would hike rates nearly 5%. affected neighbored would include shoreline, paradise. 900 residental and commercial customers are involved the increase would bring the cost of a 32 gallon garbage began to $39.82 a month or nearly $2 more than what they pay now >> this week santa cruz is scheduled to consider several

measures designed to protect the environment. a ban on plastic bags another proposal would ban the sale of foam a third measure could tackle the way electronic waste is recycled. if the council gives approval final vote could come the end of the month. triple digits expected the bay area later this week making conditions dry and dangerous for firefighters. it was a busy day sunday. several grass fires erupted in bay point a fire blackened 20 acres came close to hopes. firefighters relied on mutual aid to put out the blaze. in benicia firefighters put out a blaze rail ties caught fire and made the location difficult for firefighters to reach with normal gear. rail service to sacramento was delayed for several hours. 5:07.

good morning many hope you had a great weekend was good. but it ended. >> yeah, i know it is monday, thanks for joining us i'm kristen sze. i'm eric thomas. latest on developing news out of oakland. five are hospitalized with gunshot wounds after being shot outside a movie theater last night. >> amy hollyfield is live near the scene. >> reporter: as you know, oakland is known for having pockets of violence. this area is not known as one of those areas. jack london square is considered safe. the people last night were throwing their popcorn and running for safety. people who were here at the movie theater describe a chaotic scene. a lot of people were in line trying to get a ticket when shots were fired. people say there was shoving, as people were trying to get inside or get anywhere but here. this happened around 9:00 in front of the regal cinemas at second and washington in the jack london square area.

five people were shot, no arrests were made. >> bunch of kids out here planning to go to the movies to see spider-man car pull up and start shooting. >> reporter: then what happened? >> everybody start running. that was it. >> reporter: three victims drove themselves to the hospital police discovered one victim in front of the theater, another was a block away. all are expected to survive. police have a -- had a crazy out of control scene, scared witnesses and scattered victims. at this point no arrests have been made. amy hollyfield, abc7 news. former software company owner convicted of murdering his wife is scheduled to be back in court this morning where a jury selection begins in civil court.

hans reiser's children have filed a wrongful death suit against their father they want compensation for the murder of their mother. he was sentenced to 15 years to life after he led authorities to her body. the lawsuit asks for unspecified damages to be paid to the children by riser. family members believe he may have had -- have money hidden. >> they have suffered. somebody took their mother if anybody else had taken their mother in a car accident or something else they could be entitle told compensation. it is no different the fact it was their father other than the fact it is more tragic. >> hans reiser plans to represent himself in the civil trial as he did in the criminal trial. the children won't be in court they are living in russia with their maternal grandmother.'l tonight occupy protesters plan to protest the city council meeting because they want to keep a piece of uc berkeley owned property undeveloped. over the weekend they returned to the farm site.

they harvested some of the crops they planned while they occupied the land. police cleared everyone out may 14th, making several arrests. university offs want the site to be used as an open air lab. occupy protesters will rally ahead of a 7:30 meeting where a public hearing will be held. in the mendocino national forest wildfire threatening 25 structures has forced evacuation of nearby campgrounds. the fire has grown to 1200 acres. it started saturday afternoon. the mill valley, mill creek and lake campgrounds were evacuated and closed over the weekend. the cause of the fire is under investigation. into injuries reported. containment was expected friday all that has changed now that winds have expanded the fire. this morning investigators in oakland -- >> are trying to determine the cause of a fire that injured a firefighter. flames broke out in the

downtown area yesterday morning quick action by firefighters had the blaze under control in less than a half hour. fire crews managed to stop the flames from spreading. a firefighters -- a firefighter suffered burns and was taken for treatment. they are calling this latest fire suspicious. hospital officials in san francisco are asking for the public's help in identifying a patient who fell from a freeway overpass. they've released this picture of him. he appears to be a latino man in his 20s, with dark hair, brown eyes, 5'4 and 145 pounds he fell from the 280 freeway overpass saturday wearing a black t-shirt and light pants he is still unconscious and has severe head trauma. if you have any information that can help identify him call san francisco general hospital. this morning ground will be broken on a new air traffic control tower at san francisco international. federal officials, including

secretary of transportation ray lahood will join mayor lee for the groundbreaking. this is time lapsed animated video of the project posted online by the airport. faa says the critical infrastructure project will create local jobs and increase safety. new tower is expected to be completed 2014. expect detours today in berkeley as crews begin road repairs from 9 a.m. to 3:00 in the afternoon it will affect two sections of the road northbound from adeline to california street and southbound from san pablo to california and california to adeline. one lane in each direction of ashby will remain open. cross streets will be closed as construction moves through the area. resurfacing work will continue all week on various stretches of busy ashby avenue so be aware of that >> time for the weather

rank choice for city wide offices was approved by so thers in 2002. the race for district attorneys, city treasure esch, sheriff, board of supervisor and other -- officers would remain rank choice under the plan. in petaluma three men under arrest for stealing property out of 18 public storage units. they were caught with stolen vehicles which put investigators on the trail. fremont man counting his blessings this morning after frightening encounter with a shark this weekend as he was kayaking in santa cruz county. the shark left its mark on the kayak during attack. the man says the force threw him into the water. he swam a bit then jumped aboard a private boat nearby. mel described the shark saying
